By submitting this track, I represent and warrant that the information in this submission is accurate and complete to the best of my knowledge, and that I control, or am fully authorized to grant, all rights, permissions, approvals, clearances, and allowlisting needed for MARS to stream, promote, list, archive clips of, and otherwise use the submitted track in connection with MARS programming and related promotional materials.
Submitter Responsibility / No Reliance / No Waiver
I remain solely responsible for obtaining and maintaining all permissions, approvals, licenses, clearances, distributor settings, Content ID allowlisting, sample clearances, beat licenses, publishing permissions, and other rights needed for the submitted track. Any review, acceptance, scheduling, broadcast, reposting, or temporary continued availability of the track by MARS does not constitute legal advice, does not confirm that rights are cleared, does not shift responsibility to MARS, and does not waive any right of MARS under these terms.
Non-Exclusive License
I grant MARS a non-exclusive, worldwide, royalty-free license during the period the submission remains active with MARS to stream, program, publicly perform where applicable, display metadata, promote, and use excerpts of the track, artist name, track title, approved artwork, and related submission materials in connection with the MARS YouTube stream, related MARS channels, schedules, playlists, social promotion, archives, and station identification.
No Obligation to Broadcast
Submission does not guarantee acceptance, rotation, promotion, or continued availability. All programming, scheduling, and editorial decisions remain solely within MARS’s discretion.
Programming / Technical Edits
MARS may make reasonable technical or programming edits for broadcast presentation, including fades, trims, level matching, station IDs, metadata display, and transitions, provided the fundamental musical work is not materially altered.
Metadata / Artwork / Promotion Use
MARS may use the artist name, project name, track title, genre, bio excerpt, cover art, links, and submission metadata for on-screen now-playing displays, program listings, social promotion, archives, and other MARS promotional uses related to the submitted track.
Content ID / Distributor Responsibility
If the track is registered with a distributor, publisher, label, administrator, content owner, or Content ID system, I will ensure that MARS has the permissions and allowlisting needed to avoid interruption, muting, blocking, or claims on the MARS stream, and I will promptly take any action reasonably requested to resolve any claim or rights conflict.
Indemnity
I agree to indemnify, defend, and hold harmless Music Alliance, MARS, and their officers, directors, members, employees, volunteers, contractors, hosts, operators, affiliates, partners, and agents from and against any third-party claims, allegations, takedowns, Content ID claims, copyright claims, damages, losses, liabilities, judgments, costs, and reasonable expenses arising out of or related to the submitted track, inaccurate submission information, breach of these terms, lack of authority, or failure to secure required rights or approvals.
Takedown / Cure / Sole Remedy
If MARS receives a claim, dispute, takedown request, Content ID issue, legal complaint, or otherwise reasonably believes the submitted track may create legal or platform risk, MARS may suspend, mute, block, remove, or decline to air the track immediately. Removal or disabling of the track by MARS within seventy-two (72) hours after notice to the submitter, or sooner if MARS determines faster action is reasonably necessary, will constitute MARS’s full performance of its obligations in response to that issue and, to the maximum extent permitted by law, the submitter agrees that such removal or disabling is the submitter’s sole and exclusive remedy against MARS arising from that issue.
Limitation of Liability
To the maximum extent permitted by law, MARS will not be liable for lost royalties, lost profits, lost opportunities, reputational harm, platform actions, interruptions, muted audio, demonetization, or any indirect, incidental, special, consequential, or punitive damages arising from or related to review, rejection, scheduling, descheduling, removal, or non-broadcast of submitted material.
